U.S. Customs and Border Protection (CBP) has announced their Consolidated Administration and Processing of Entries (CAPE) tool is now available. This tool was created to facilitate the consolidated refund of tariffs issued under the International Emergency Economic Powers Act (IEEPA). Previous CBP announcements have estimated a 2 to 3 month timeframe from CAPE Declaration acceptance to refund receipt.
To initiate the refund process, importers of record and certain brokers will need to access the Automated Commercial Environment Secure Data Portal (ACE Portal) to create and upload a CAPE Declaration. Therefore, if you do not have an ACE portal account, the first step is to enroll and ensure the Form 5106 is completed and up to date. To access ACE, apply for an ACE Secure Data Portal, and access the CAPE system for refunds, use the link here.
CAPE is being rolled out in a phased approach, with this initial phase allowing “certain unliquidated entries and certain entries within 80 days of liquidation” only. More information will continue to be issued on future phases at the CBP’s International Emergency Economic Powers Act (IEEPA) Duty Refunds website.
