A Decade of FCPA Enforcement: Lessons for Corporate Counsel

A decade after the U.S. Department of Justice (DOJ) issued the Yates memorandum, individual accountability and corporate cooperation have moved from policy concepts to decisive enforcement tools. Based on an analysis of 99 Foreign Corrupt Practices Act (FCPA) enforcement actions resolved between 2015 and 2025, this webinar examines what DOJ enforcement outcomes over the past decade reveal about how companies are evaluated, and why some fare better than others.

This session of the Forensics Institute is designed for in‑house counsel, compliance leaders, and external legal advisers who are responsible for navigating investigations, disclosure decisions, and remediation under real‑world pressure. We’ll explore how bribery schemes are commonly structured, where corruption risks often emerge, and how organizational responses influence resolution types, penalty reductions, and enforcement credit.

In addition, the webinar will address how anti‑bribery and anti‑corruption (ABAC) enforcement is currently being handled in Europe, including how multinational organizations are navigating evolving expectations amid recent shifts in FCPA enforcement posture.

The discussion will also focus on what the data shows the DOJ values, including timely internal investigations, credible cooperation, disciplined remediation, and well‑reasoned disclosure decisions.
